From what ive read (from various sources, reliable and otherwise) the only thing that really seems in debate is whether its actually spyware or not. And *that* is only because EA actually say that they are collecting your information whilst you are online, thus negating the normal secretive part of spyware.

We have no way of knowing what "the software' is, it could be saying that when you play 2142 info is collected, or it could be saying that they're hooking your browser to shit to see exactly what you do.
Personally, I would not take the claims of spyware seriously yet, it all smells a bit of tabloid hype.
What EA/DICE have said is that it does not collect any data outside of the game, and your IP is used to determine region for ad purposes. They track how long an ad is rendered on the screen to see how much exposure it gets.

May or may not be spyware, but it is adware, with some sort of data collection (whether of consumers or advertisers), which some might argue is just as bad.
It's not the main reason I won't be buying it, but it is a factor.
Gamers don't neccessarily stop buying products from companies they dislike (as a recent poll here demonstrated) I expect EA just calculated the revenue to be earned from the adverts outweighed any drop in sales as a result, so they don't give a fuck really and just count the dollars.

While it is sorta adware-ish maybe (it does display ads, in certain places in a single game) It's certainly not what we usually think of as adware, given it's non-intrusive, easy to remove and an advertised feature.
Also the Information it takes is basically for verifying where you are so you get adverts for english products and checking how much viewing time an advert gets (so they can shockingly discover that a new mouse or a can of lynx is more interesting to 2142 players than tampax)
