I'll wait for the official annoucement though, strange though, by all accounts Duke 4 was pretty much finished :/

Apogee Software is officially not affected by the situation at 3DRealms. Development of the Duke Nukem Trilogy is continuing as planned ...

Well, Apogee is a seperate company now after it was relaunched last year (maybe year before?), but obviously still tied with very close links.

And being completely honest, if 3dRealms has closed, it would not suprise me if Apogee get the full IP rights to Duke for a token sum of money, and if rumours are true about Duke 4 being 95%, it might get finished off there.

I'm sure this game was being developed back when I had an AMD 450 and 256mb RAM.

Hmm, stranger and stranger.

A bucket load of Cease and Desist letters must have been sent out as all the sources of "new" art have all been taken down in the last 48 hours, although that's probably related to NDA's seeing as the game was near enough complete.

But oddly, the 100 page thread of rumours, collation of art etc... has vanished from the 3dRealms forums, it was locked yesterday by a mod with a comment of "lets wait for new information" and it's completely gone today.

And still no proper official word, despite activity at the office as a couple of people had said they'd driven past and seen 30ish cars outside the 3dRealms office (although, that could be anything, you'd expect trucks if it were removal staff though).

The 30-ish people that worked there either collecting their personal belongings, or hearing an announcement in a meeting. The fact that someone wants to buy what they have in some capacity wouldn't be surprising, being allowed to carry on as they were would be.

Take-Two Sues Apogee Over ‘Duke Nukem’ Game Sequel

Take-Two Interactive Software Inc., the maker of the “Grand Theft Auto” video games, sued Apogee Software Ltd.’s 3D Realms over the failed development of a sequel to the “Duke Nukem” game called “Duke Nukem Forever.”

Take-Two, owner of the publishing rights to the game, said Apogee breached an agreement to design the latest installment of Duke Nukem, a game in which the player “shoots” enemies. The new version has been under development since 1997, the company said yesterday in a complaint in a state court in Manhattan.

3D Realms, which was based in Garland, Texas, never produced the game and instead closed its studio on May 6, terminated development of the game and fired employees who had been involved in the Duke Nukem project, Take-Two said.

“Apogee continually delayed the completion date for the Duke Nukem Forever,” Take-Two said in the complaint. “Apogee repeatedly assured Take-Two and the video-gaming community that it was diligently working toward competing development of the PC Version of the Duke Nukem Forever.”

Take-Two said in 2000 it had an agreement with Apogee and paid $12 million for publishing rights to the forthcoming game. In 2007, the two companies entered into a second agreement.

The case is Take-Two Interactive Software, Inc. v. Apogee Software Ltd. 601457/2009, New York State Supreme Court, New York County (Manhattan).
TakeTwo are now suing 3dRealms for contract breach.

Offically fucked then, legal battle will take ages.
