Creadit cards = harassment
Ok well i went to a debt management company to deal with my 3 creadit cards because i cant keep up with payment. So far Halifaxs not giving me any problems since the last call when i told them about josua brookes.
Problem is MBNA. They calling me 6-7 times aday and ITs really winding me up. I spoken to the manager to day as he called me. I told them about joshua brooks but they ignore me and threaten me with court action etc and we have had no paper off them etc etc. Joshua said we have sent them paper work and they given some of you account details but there not answered any of are letters now.
MBNA I feel is stalling and trying to put pressure on me to make payments which not working because i going to fire bomb there office in Chester in a min. Even tho i owe money Do they have a given right to call me 7 times day?
Also the manager was rude and arrogent and left a message having a go at me for hanging up on him O.o He just called again and just done the same. There using different mobile number to 0800 numbers to Withheld numbers. he even said said if i dont call back before 8pm tonight they take it to the next step. We also keep calling you until you made your payment! I like GRRR
I spoken to joshua and said they trying to bully you in the corner to give in. Ignore the calls and if you answer keep giving them are number. IF they take you to court fine we will back you because we trying to deal with it and they are ignoring us. You are trying to sort it but again they ignoring us.
So i like ok fine but these calls are really getting on my nerves. can i contact the police and have a word about this or bt? I having a hard time to not get depressed and try not to stress but they making go that way :/
Look I look it over and done my best with gramma and i am still wound up. Any advice?

You have only got a case in law if their actions are not reasonable.
If you were to have a single conversation with a bank, then I would argue that anything after this constitutes harassment.
In all honesty though, I would just talk to them once and agree a solution with them, and then not answer the phone to them afterwards. I'm not even sure MBNA are UK based which would complicate things further.
Protection from Harassment Act 1997
You might want to have a chat with your local Citizens Advice Bureau about what options you have.

Code: Select all
(1) A person must not pursue a course of conduct-
(a) which amounts to harassment of another, and
(b) which he knows or ought to know amounts to harassment of the other.
(2) For the purposes of this section, the person whose course of conduct is in question ought to know that it amounts to harassment of another if a reasonable person in possession of the same information would think the course of conduct amounted to harassment of the other.
(3) Subsection (1) does not apply to a course of conduct if the person who pursued it shows-
(a) that it was pursued for the purpose of preventing or detecting crime,
(b) that it was pursued under any enactment or rule of law or to comply with any condition or requirement imposed by any person under any enactment, or
(c) that in the particular circumstances the pursuit of the course of conduct was reasonable.http://www.citizensadvice.org.uk/

Tell who ever it is that is phoning you that you have sorted out your debt through another agency who are trying to deal with their company, Ask for a supervisor to speak to. Explain to them what the situation is and don't threaten anything, just explain polietly that if they do not stop the harrasment that you will informt he obudsman about the company, usually the mention of obdsman(sp?) is enough to get them to calm down.

Few questions for background info:
1) How old is the MBNA debt?
2) Without wanting to pry too much, are we talking about a reasonably chunky amount here?
3) Have you ever ignored their requests for repayment in the past? Only reason I ask is that the only time I ever withhold a number is because I know the person on the other end won't pick up if they know it's me (i.e. my mother
)
I'd take the advise of Joshua Brooks and refer all MBNA's calls to them. I know it may grate, but be polite about it. Hanging up on them etc will only make them more determined to string you up by the balls.
Make a budget. Cut your spending down to the bare essentials. You'd be amazed how much you can save by not buying alcohol (I know, but some sacrifices need to be made) and cooking your own food rather than buying ready meals. Got any DVDs or computer games lying around that you've got no use for? Flog 'em to Cash Generator.
Filing the above you cold always become a rent boy.

I used to think that, I didn't have one for years, then when I did get one I didn't use it.deject wrote:This is why credit cards are evil. Just get one and don't really use it.
Then one saved me one of the first times I'd used it. Basically I bought a £2,600 item which was never delivered and the company went bankrupt six weeks after purchase. The credit card company (Thank you Halifax and "Section 75 of the Consumer Credit Act") in a nutshell said "No problem, here's your money". If I'd used my Barclays Debit card like I always had done, I'd have been pwned. (Full story here if you're interested)
If you have a credit card, it's very simple. As soon as you get it you ring them up and say "I'd like the full amount paid off each month by direct debit" they will do this (even though they don't like it as you don't make them money in interest) and then treat the card like a debit card and don't spend money you don't have.
Using this system you can even make some beer money by just using the card.

As was mentioned, pay off the full amount every month without fail and it'll be fine.
I deals with store credit cards at work, utter cunts spring to mind when dealing with the financial institution (GE Capital/GE Money) that run it.
Saying that, our direct business to business customer liasons is rather great. Just the cunts in India who don't have a fucking clue.

Thirded on the CAB thing. They are awesome. Helped me no end when my last landlord tried to sure me for several grand. They can write letters for you, and can even speak to banks and things on your behalf, if you give them consent.
