Seem to remember they did get in trouble for what Marvel claimed was a "Wolverine Construction Kit". Quite how they imagine press releases about their lawyers stamping on people who "copy" them will increase revenue escapes me.

They did, briefly. It was a fucking flimsy argument though.
Indeed, although I don't know how these things work.
One can imagine claiming mitigation that your game doesn't just feature characters with retractable claws, but also ones who can shoot webs, or shoot lasers out of their eyes not being the most robust defense.
Perhaps, somewhere a committee was set up to determine which superhero abilties were sufficiently generic to be allowed - flying, super strength, etc.
