It's time for a new twist in the tale of Duke Nukem Forever. Shacknews are reporting that Take-Two are now filing a lawsuit against the remnants of Apogee and 3D Realms, suing them for failing to deliver the promised game, and demanding a copy of the source code. Cor blimey. In a round-up of who's suing who today, business news site Bloomberg mentions the case, stating that Take-Two are making the case because "Apogee breached an agreement to design the latest installment of Duke Nukem." And in recently discovered papers, it's been revealed that the publisher are demanding a copy of the source code, and assurance that none of the game be leaked or destroyed.

If it does, I highly doubt it'll be Duke.

Take Two didn't pay 3dRealms that 12 million, another of other sites confirm that, they paid the previous publisher for the publishing rights. Not 3dRealms.

While it's not known what the 2nd agreement is, the first one (12 mil) wouldn't stand up on court for shit, so there's no chance of Take Two getting 12 mill from 3dRealms for that contract as they've dealt with a 3rd party and haven't for that contract put any funds in.

I reckon that when GB showed Take Two the current build in January they realised just how good it was and that it would sell very very well, and that they've got a shitty publishing deal.
For 3dRealms to self fund it, they must be expecting massive returns from selling the game via a publisher otherwise they'd do it all themselves. I think that Take Two turned down the 5million that GB asked for, offered the 30mil for the game which was turned down in an attempt to get the game and to maximise their profits, and now they're going all out because if they win and the game is good, they will have spent NOTHING on it's development and will easily recoup the 12 million on the publishing contract.

It seems far to shady for it to be just a simple contract breech as that would not reach court. I personally think Take Two are just being greedy, they've got the cash to spend the $5 million for 3dRealms to get the game finished.

I just hope that they don't get the restraining order on the development or release, as that will kill the 3dRealms version of the game, and I hope that the suit goes in 3dRealms favour.
